What is the Hillcrest class action about?

Maurice Blackburn is acting on behalf of the families of the children who died in the Hillcrest Primary School jumping castle and zorb ball incident which occurred on 16 December 2021 (“the incident”).

We are also acting on behalf of students who were injured and who witnessed the incident.

The class action is against the State of Tasmania and the owners/operators of Taz-Zorb.

The case has been commenced in the Supreme Court of Tasmania.

Am I part of the class action?

You may be eligible to join the class action if:

  • You were one of the children injured during the incident
  • You are a close family member (including parent, legal guardian or sibling) of one of the deceased or injured children
  • You or your child witnessed the incident or the immediate aftermath of the incident
     

Do I need to register?

We strongly recommend you register.

We recommend registering your interest in the class action for the following reasons:

  1. Registration means we can contact you to tell you about the proceedings and advise if you are eligible to apply

  2. Registration means we can contact you to tell you about any decisions the Court makes that may affect your ability to claim compensation.

No. It will not cost you anything to be part of the class action.

All costs in the proceeding will be borne by Maurice Blackburn unless and until there is a successful outcome.

In the event of a successful outcome, any costs payable by Maurice Blackburn will be deducted from, and will not exceed, any compensation you are entitled to receive.

All such costs are required to be considered and approved by the Court.

We are not able to predict how much compensation group members may receive. It is likely to be different from person to person.

These types of cases can run for several years before a final outcome.

The duration of proceedings may depend on a number of factors, including when the criminal prosecution by Worksafe Tasmania is concluded, the pending coronial inquest, and the response of the State of Tasmania and the operators of Taz-Zorb to the case.
