Workers' compensation claim frequently asked questions

Workers’ compensation is an insurance scheme that protects workers if they’re injured or become sick due to work. These insurance premiums are paid by employers.

All Australian employees should be covered by a workers' compensation scheme, as all employers should have workers' compensation insurance. This applies to full time workers, part-time workers, casual employees and subcontractors.

Workers' compensation covers all 'reasonable' expenses related to your work injury or illness. This will differ depending on where you live and what scheme you're covered by, but can include:

  • payments for lost wages
  • medical costs such as hospital and nursing
  • personal, household and occupational expenses
  • doctors and chemists
  • physiotherapy and chiropractic care
  • rehabilitation
  • ambulance services
  • attendant care
  • modifications to a home or car
  • home help
  • transportation costs

If you are required to travel as part of your work, you may be able to make a workers' compensation claim. For example, a taxi driver would be able to make workers’ compensation claim if they were injured on the road. However, if you were travelling from your home to your regular place of work and you were injured during your commute, you may be covered by workers' compensation depending on what state you live in, but would likely be covered by the road accident insurance scheme in your state.

It’s our mission to ensure you get your full compensation payout to help you get back to being you as soon as possible. The amount of compensation you receive will depend on your impairment level, date of injury, and the law that covers your worker's compensation.

You may receive payments that are equal to a percentage of your weekly earnings, along with payment for all reasonable medical and associated expenses. You can claim a lump sum in cases where the injury has caused permanent impairment.

Get in touch with one of our workplace injury lawyers, we can help you assess your claim based on the details surrounding your injury.

How long a claim takes can vary greatly depending on the state you live in, the severity of your injury and whether or not your injury has stabilisied. It’s best to seek legal advice as soon as possible to find out what your options are.

Time limits for work injury claims vary under the different laws, depending on where you live.

It’s important that you report your work-related injury to both your employer and the workers’ compensation authority that covers you as soon as possible. It’s best to do this within 30 days of the incident or once you’ve become aware of your injury or illness.
